Q:  Since Texas is a community property state, why should I hire a lawyer? Won’t I just get half of the property acquired during marriage?

A:  Not necessarily. The Judge divides the property in a manner that is “just and right.” This division may include considering such factors as: the earning capacity of each spouse, the relative education  of each spouse and/or who is “at fault” in causing the divorce.

Q:  All the property is in my name. Why do I need a lawyer to divide it?

A:  Property in Texas generally derives its character from the “inception of title" or when it was acquired. Even if the property is in your name, property acquired during marriage except by gift or inheritance generally belongs to the both of you.

Q:  Can you guarantee that I will win my divorce?

A: No, a lawyer cannot and should not make such guarantees. What we can guarantee is that we will aggressively advocate on your behalf, setting forth our best arguments in light of the facts of your particular situation. We will be honest with you in our assessment of your situation and your best possible outcome

Q:  What does Joint Custody mean?

A:  The law presumes, that, other things being equal, the parents shall have “joint custody” of the children of the marriage; however, joint custody can mean anything from almost equal possession to supervised visitation. You need an experienced lawyer to advise you on these matters.

Q:  He was physically abusive to me after our child was born – will that keep him from getting custody?

A:  Whether a parent was physically abusive to the other parent is one factor that the court may consider in avoiding custody or visitation.

Q:  The stock in my corporation is all in my name, does that mean the corporation is mine?

A:  Not necessarily. If the corporation was formed during the marriage the stock may be community property.
